BPM CEO to Take Legal Action Amidst Fraud Allegations and Hostile Takeover Claims
On the 10th, Cha's legal representative, Attorney Hyun Dong-yeop, addressed the ongoing dispute with Nomers, stating, "Due to Nomers' clear breach of contract, including the 'From' service disruption, the trust relationship has completely collapsed." He added, "We are holding the advance payment as collateral for offsetting until a settlement is reached, which is a legitimate exercise of legal rights in corporate disputes. Framing this as fraud distorts the essence of the issue."
Attorney Hyun further claimed that the purpose of the fraud allegations, which involve hundreds of billions of won, is to seize management control. He stated, "This lawsuit is a false accusation orchestrated by Cha Jun-young and Nomers to systematically take over Cha Ga-won's company and its artists. They have spread false information and manipulated public opinion to justify their illegal hostile takeover attempts."
Hyun noted that the court has already granted an injunction against a media outlet for false reporting, and they plan to file a 100 billion won damages lawsuit against the outlet.
He pointed out that these external hostile attacks and false reports have caused a real management crisis for the company. "The illegal actions and malicious articles from the opposing side have led to a decline in the company's external credibility and worsened financial conditions, causing significant management disruptions," Hyun explained. He attributed the current artist settlement issues to these external pressures distorting the company's cash flow.
Regarding the ongoing police investigation, Hyun asserted innocence. He stated, "The documents seized during the search were already being prepared by the attorney for submission as part of normal contract-related materials. The seized phone contains ample evidence to prove Cha Ga-won's innocence and reveal the opposing side's collusion. We will actively participate in the forensic process to secure a non-indictment decision."
Finally, Hyun emphasized, "We will not yield to the opposing party's malicious claims and will clearly reveal the truth. We will take all necessary civil and criminal legal actions against the spread of false information and defamation to protect the company's normalization and the artists."
