Legal Experts Weigh In on Custody Battle Between Former Laboum Member Yulhee and FT Island's Choi Minhwan
The legal community has offered insights into the custody battle between former Laboum member Yulhee and her ex-husband, FT Island's Choi Minhwan.
On October 11, YTN Radio's 'Consultation Room with Lawyer Jo In-seop' discussed the division of assets and custody adjustment between Choi Minhwan and Yulhee. On October 4, Yulhee filed for a custody change, alimony, and property division against her ex-husband, Choi Minhwan, while revealing allegations of his involvement in prostitution.
Attorney Kim So-yeon, who appeared on the radio show, explained, "The Civil Code allows for changes in custody if necessary for the child's welfare, even if custody was determined at the time of divorce."
However, Kim noted that the outcome of the custody adjustment is uncertain, stating, "There is a tendency to maintain the current nurturing environment if the child is growing well." Lawyer Jo In-seop mentioned, "There are articles suggesting the possibility of changing custody," but added, "From a professional standpoint, custody was already decided in favor of the father during the divorce. The court considers the parents' willingness to nurture important, and Yulhee's decision to relinquish custody during the divorce might be disadvantageous for her."
Jo further explained, "The court prioritizes maintaining the children's nurturing environment when deciding custody, known legally as the 'principle of continuity.'"
He continued, "It seems the children have been living with Choi Minhwan's parents for a long time, and his mother is currently assisting with childcare. Economically, they appear to be stable, making custody adjustment challenging."
However, both lawyers noted that if the allegations of Choi Minhwan's involvement in prostitution are true, it could impact the custody case. Kim stated, "If Choi Minhwan is convicted, it could affect custody due to its relevance to the child's welfare." Jo added, "This aspect could favor Yulhee, but it's uncertain if prostitution alone will determine custody, so the situation needs to be monitored."
