A doctor who was sentenced to prison for killing singer Shin Hae-cheol is in prison again for another medical negligence case.

On the 26th, Criminal Division 11 of the Seoul Central District Court (Pansan Shim Hyeon-geun) sentenced doctor Kang (53), who was indicted on charges of professional negligence manslaughter, to one year in prison.

Mr. Kang is accused of violating his duty of care during an operation to remove a blood clot in the deep femoral vein of a male patient in his 60s in July 2014, causing the blood vessel to rupture, resulting in death. The patient, in his 60s, suffered massive bleeding while undergoing surgery performed by Mr. Kang, and was immediately transferred to another hospital for surgery and treatment, but eventually died in 2016.

Mr. Kang argued that the causal relationship between his professional negligence and the victim's death was not proven because the patient died about 20 months after the surgery, but the court's judgment was different. The court ruled, "When the patient was transferred to another hospital, loss of spontaneous breathing, thrombosis, cerebral hemorrhage, and decreased brain function were already confirmed," and "This occurred due to Mr. Kang's surgery and post-operative measures."

This is already the third time that Mr. Kang has been sentenced to prison for medical malpractice. In particular, the late Shin Hae-cheol died on October 27, 2014 from hypoxic-ischemic brain damage due to a perforation after receiving gastric band surgery from Mr. Kang. At the time, Mr. Kang denied the charges, but was sentenced to one year in prison in May 2018 on charges of professional negligence manslaughter.

It's not the end. Mr. Kang was also indicted on charges of leaving unnecessary scars after performing liposuction on a woman in her 30s in October 2013, and causing the death of an Australian man from aftereffects after gastrectomy surgery in November 2015 (occupational manslaughter). In January 2018, he was sentenced to 1 year and 2 months in prison.

As such, there is strong public criticism that Mr. Kang continues to hold the knife in the operating room even though he continues to cause medical accidents and the number of victims continues to increase. Under the current medical law, even if a medical license is revoked, it can be reissued upon application after up to three years.

Accordingly, there are voices calling for doctors who commit serious medical accidents to have their medical licenses permanently revoked.
