Woman Convicted for Defamatory Comments Against K-Pop Star IU
A woman in her 30s has been convicted in the first trial for posting defamatory comments about singer and actress IU, whose real name is Lee Ji-eun.
The Seoul Central District Court, under Judge Lee Kyung-sun, sentenced the woman, identified as A, to a fine of 3 million won for charges of insult.
The court stated, "The expressions used by the defendant are insulting and derogatory personal attacks in the usual sense," adding that "this exceeds the limits of opinion expression as per Supreme Court precedents and constitutes the crime of insult."
The court considered "the nature and circumstances of the crime, as well as the defendant's previous criminal record of being fined for defamation," in determining the sentence.
A, who appeared in court without detention, failed to reach a settlement with IU's side. A pleaded for leniency, claiming, "I was merely expressing personal preferences and suffer from mental illness, which affects my writing ability." The defense argued that the comments were based on objective facts and did not constitute insult, but the court did not accept this argument.
A was accused of posting four derogatory comments about IU's outfits, singing skills, and remarks in April 2022. Prosecutors had sought a four-month prison sentence during the final trial last month, but the court opted for a fine instead.
Meanwhile, IU's team continues to pursue legal action against various crimes, including threats, insults, and illegal information distribution. IU's agency, EDAM Entertainment, announced on the 11th of last month, "There are currently over 180 defendants, and we are continuing to file additional lawsuits."
