Shin Hye-seong, prosecutors want a prison sentence until the end, "I ask for 2 years in prison"
On the morning of the 15th, the 3rd Criminal Division of the Seoul Eastern District Court held the first appeal trial for Shin Hye-seong, who was indicted on charges of refusing a breathalyzer test in violation of the Road Traffic Act and illegally using a car. This appeal trial comes approximately 11 months after the first trial in April last year.
On this day, the prosecution claimed unfair sentencing for Shin Hye-seong, who had previously been sentenced to probation, and requested a two-year prison sentence, as in the first trial.
On the other hand, Shin Hye-seong's lawyer appealed to dismiss the prosecution's appeal, saying, "The defendant is deeply reflecting and remorseful." Shin Hye-sung also said in a statement, "I am deeply remorseful and reflecting," and bowed her head, saying, "I will make sure something like this never happens again. I am truly sorry."
In October 2022, Shin Hye-sung drank at a restaurant in Nonhyeon-dong, Gangnam-gu, Seoul, and fell asleep at Tancheon 2 Bridge in Songpa-gu while driving home in someone else's vehicle early in the morning the next day. The police, who received a report that 'a vehicle was stopped in the middle of the road', asked Shin Hye-seong to take a breathalyzer test, but she refused, and Shin Hye-seong was arrested red-handed.
Shin Hye-seong was found to have driven approximately 10 km while intoxicated. In addition, there was a risk of being accused of theft because she was driving someone else's car, but the police judged that Shin Hye-sung did not intend to steal the car, so they sent her to the prosecution on charges of illegal use of a car instead of theft.
The first trial court sentenced Shin Hye-seong to six months in prison and one year of probation. At the time, the court ruled that Shin Hye-seong's act of interfering with and refusing to take a breathalyzer test was not a light one, and that she had been booked for drunk driving once in the past, but took into consideration that Shin Hye-seong acknowledged and reflected on her crime and had reached an agreement with the vehicle owner. He stated that he was sentenced in this way.
However, the prosecution, which had sought a two-year prison sentence for Shin Hye-seong, dissent from the first trial ruling and appealed.
Meanwhile, Shin Hye-sung was booked on charges of drunk driving in April 2007. At the time, Shin Hye-seong's blood alcohol level was 0.097%, which is the level for license suspension.
