Trademark registration in contract disputes, Fifty Fifty has plans

According to the patent information search service on the 6th, the Korean name Fifty Fifty was applied for trademark rights on the 19th of last month under the names of four people, not the agency Attract.
These are members Aran (Jung Eun-ah), Kina (Song Ja-kyung), Saena (Jeong Se-hyeon), and Shio (Ji-ho Jeong), and they are ▲03 (non-medical cosmetics and toiletries) ▲21 (household or kitchen utensils and containers) ▲38 (Telecommunications service industry) ▲Class 18 (leather and imitation leather) ▲Class 35 (advertisement) ▲Class 05 (tea and non-alcoholic beverages), a total of 12 trademarks have been applied for.
There was an interpretation that the paving stones were laid in advance for future activities. In this regard, Attract said, "We applied for the Fifty Fifty Korean trademark on May 15th for the singer performance industry, and on June 15th, we applied for additional classifications for other classifications." We have the right to it," he said.
Regarding the newly released case with a Korean name, he emphasized, "Because Korean and English are treated the same, the right belongs to us, who have already completed registration."
Attract said, "Rather than winning a preliminary injunction, we hope to resolve this case as soon as possible through amicable discussions with the artists." However, with the current situation where Fifty Fifty members have applied for a provisional injunction to suspend the validity of the exclusive contract and have even applied for trademark rights, it is a common opinion that it is difficult to seal the relationship.
Under the current law, the exercise of the trademark right is possible only with the consent of the applicant. This is also the reason why many idol groups who have filled the contract period with their agency have not been able to use the group name even after leaving the company.
