'The Home Judge' aroused interest with the conflict between favor and rights.
On the JTBC legal entertainment talk show 'Home Judge', which aired on the 14th, a hair designer and manager attracted attention by suing an employee who committed small but definite embezzlement, also known as 'small fraud.' After a tense battle between lawyers on both sides, Judge Anbang ruled in favor of the manager.
In a video filmed from the perspective of the complainant manager, the accused employee was caught taking the leftover spray to his locker, although he was good at his job. In addition, the employee who came in first place dyed his own bangs with a hair shop product, used equipment for testing purposes without the manager's permission, and purchased mouthwash, toothbrush, and lens preservative with the manager's personal card given to purchase snacks, which was absurd. made me do it
The manager said that he wanted to take better care of his first student as he himself had gone through difficult times as a staff member, and that he allowed the employee to use his personal card out of affection for his first student. In addition, since the beauty salon has the concept of an individual business and does not use corporate cards, the manager's personal card was virtually no different from the corporate card.
In particular, the manager who handed over the employee's personal card again for lunch checked the receipt and called the employee to the fitting room. He spent a whopping 108,000 won on lunch with a senior employee. The manager expressed his anger by saying, “If I’m good at my job, you spend everything,” and “Am I raising my daughter?” Hong Jin-kyung, the staff member who defended her client for the first time, also gave a quick laugh as she quickly got tired and said, "I can't shield at 108,000 won" when the amount was larger than expected.
While it was unclear how much was favor and how much was a right, the defense team's question-and-answer session began. The employee admitted that when he lived on his own and was short of money, he had to use supplies to cover daily necessities. Regarding the specific purpose of using the personal card, the manager said, "Eat food," and surprised those who saw the employee eating with other staff members, saying that he was spending an average of 3 to 5 million won per month on meals.
The manager's defense strategy was to claim embezzlement and breach of trust based on personal use, while the employee's defense strategy was to claim innocence based on social norms. After a fierce argument, the home judge ruled in favor of the manager, but also ordered that the manager set clear standards in the future since he had vaguely announced the standards for favor and welfare.
Accordingly, from now on, the limit has been set at 1 million won and it will only be spent on things for employees. The employee accepted his mistake, and the manager also realized that his ambiguous standards had become a problem and said he would maintain a good relationship by setting a line.
In 'Law How', a corner for teaching legal secrets, we had a useful time learning about laws on preventing and countering school violence. We were able to hear the lawyers' thoughts on everything from the real-life curling iron incident 17 years ago to how to ask for help in a school violence situation, how to effectively collect evidence, and the controversy over lowering the age for juvenile delinquency.
